Mediation is a process in which a neutral third party (known as a mediator or neutral) assists the parties in developing and exploring their underlying interests and legal positions to determine possible options which may result in resolution of the disputes, in whole or in part. The idea is to empower mediation participants to reap the benefits of peacemaking and bridge-building without judgment.
Think about what happens with your conflict without mediation. A judge or a jury will make choices for you. The choices will be based on general standards. Your particular interests will not determine the outcome.
- Choose mediation because you want the outcome to be based on choices you make.
- Choose mediation because your particular interests are important.
- Choose mediation because you want the autonomy to reach an agreement you can live with rather than this risk of a stranger making choices for you.
